Mediation & Uncontested Divorce

The quickest, most affordable way to divorce in Utah.

Mediation is the essential heart of this option: the parties agree on all terms with a mediator’s help, and never go to court for a judge to decide the matter.

How it works

It starts with mediation. Often parties believe they are in agreement, but when they proceed they discover important issues that have not yet been considered. The best way forward is to have a mediator help you clarify all issues and negotiate the terms — newly discovered issues after a divorce is finalized can cost thousands in litigation.

When you’ve reached full agreement, the attorney mediators at Long Okura draft the documents to finalize the uncontested divorce based on your agreement. The mediator meets with both parties to gather the terms and any paperwork (usually financials) needed for drafting.

Are there any additional fees over the $2,995?+

The $2,995 flat rate covers up to two hours with a court-rostered attorney mediator, who helps you clarify the terms of your divorce and drafts the agreement for both parties to review and sign. Afterwards your mediator prepares all paperwork required for filing (usually 6 to 11 documents), forwards it to both parties for review, and files with the courts on your approval. A $50 deposit reserves your appointment and is credited to the payer. If your mediation runs beyond the included two hours, the additional time is billed at $300 per hour. You also pay the court’s filing fee, and your mediator will discuss optional filings (like a Qualified Domestic Relations Order to divide retirement accounts, or a Quitclaim Deed for your home) if they apply to you.

How long will it take?+

Plan for 2 hours with the attorney mediator; both parties leave with a signed agreement. All filing paperwork is drafted and sent to both parties within 7 business days or sooner, followed by a quick 5-minute signing meeting. The initial filing happens immediately after both parties sign; due to Utah’s mandatory 30-day waiting period, the final orders are filed 30 days later. As soon as the judge signs, we forward the electronic copy to both parties.

How is this different from Full Representation?+

In our Uncontested Divorce service, your attorney mediator does not represent either party — they help you clarify your agreement, then prepare and file the paperwork, for one up-front cost with no additional bills. With full representation your attorney represents, advises, and advocates for you throughout the divorce, reachable by phone, email, or in person, billed at an hourly rate.

Do-It-Yourself Assistance

Our firm understands that an individual’s financial situation does not always include the resources to retain an attorney.

With Do-It-Yourself Assistance you represent yourself throughout your proceedings, but are provided a range of resources and legal advice without paying a retainer. You pre-pay for individual appointments or a block of time with an attorney. Assistance may include:

  • Document and argument preparation
  • A review of the pleadings required in your case
  • Creating a case strategy and plan
  • Organizing your facts and evidence productively
  • Advice on how to use the facts and evidence in your case
  • Direction on which issues matter most
  • Guidance in proposing or analyzing settlement offers
  • Tips on the Utah Rules of Civil Procedure — following them and enforcing them

What we do

You work directly with an attorney to develop a case strategy and plan. We represent you in settlement negotiations and at mediation, and can receive and respond to letters, documents, and phone calls from opposing counsel regarding negotiations. If you wish, we prepare your paperwork for you to review — you file it with the court under your own name.

Because we never enter an appearance, you stay your own representative for court purposes — and you avoid the cost of full courtroom representation. If a hearing does come up, we help you prepare arguments, understand the process, and make sure you have the paperwork you need.
